This study analyses the impact of the guideline judgment handed down in the NSW Court of Criminal Appeal case of R v Jurisic (1998) 45 NSWLR 209. The guideline relates to sentences imposed for dangerous and aggravated dangerous driving offences heard in the higher courts of NSW. This study aims to determine whether:

  • the Jurisic guideline have contributed to achieving greater consistency in the sentences imposed for these offences, and
  • as a consequence of the guideline judgment, there was a general increase in the severity of sentences imposed.

The method used to answer these questions was to compare sentencing patterns for cases decided three years before and three years after the Jurisic guideline was promulgated.
