Jurisdiction

Section 104(1): Proceedings for an offence under the Act or regulations may be dealt with:

(a) 

summarily before the Local Court, or

(b) 

summarily before the Supreme Court in its summary jurisdiction.

Maximum penalties

Section 104(2): In proceedings before the Local Court, the maximum monetary penalty that the Local Court may impose for the offence is the lesser of:

(a) 

200 penalty units in the case of an individual or 500 penalty units in the case of a corporation, despite any higher maximum penalty provided in respect of the offence, or

(b) 

the maximum monetary penalty provided by the Act in respect of the offence.

Section 104(3): Proceedings for an offence under the Act or regulations must be commenced not later than 2 years from when the offence was alleged to have been committed.
