Sentencing involves the imposition of a penalty on an offender after they plead guilty or are found guilty by a court. Penalties which may be imposed include imprisonment, an intensive correction order, a community correction order, a conditional release order, or a fine.

Sentencing law in NSW is complex and the Sentencing Bench Book is a comprehensive resource that provides commentary on the relevant principles and practices that apply. Incorporating many years of research by the Judicial Commission of NSW, as well as the input of judicial officers, the Sentencing Bench Book discusses the legislation relating to sentencing, such as the Crimes (Sentencing Procedure) Act 1999, and the relevant common law.

The Sentencing Bench Book’s purpose is to assist sentencing judges and magistrates on a day-to-day basis apply the law and take into account all of the relevant considerations when imposing a sentence. It also serves as a resource for legal practitioners, researchers, and others who seek a better understanding of sentencing law in NSW.

In addition to the commentary regarding sentencing law generally, the Sentencing Bench Book also contains commentary relating to specific offence categories such as offences of violence (including domestic violence), dangerous driving, firearms offences, and robbery.
